Terms of Service

These terms govern your access to and use of the Opsmera platform and website. By creating an account or using the service, you agree to them. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.

The service

Opsmera provides software for property operations and fire safety compliance, including deadline tracking, work orders, approvals and communications. We may update, improve or change features over time. Some features depend on third-party integrations and the accuracy of data you provide.

Accounts

You are responsible for your account credentials and for activity under your account. You must provide accurate information and keep it current. You must promptly notify us of any unauthorised use.

Your data

You retain ownership of the data you load into the platform. You grant us the limited rights needed to host and process it to provide the service. You are responsible for ensuring you have the right to upload personal information about third parties (such as owners, tenants and contractors) and for complying with applicable privacy and call-recording laws. Our handling of personal information is described in the Privacy Policy.

Acceptable use

  • Do not use the service unlawfully or to infringe others' rights.
  • Do not attempt to breach security, probe, or disrupt the service.
  • Do not upload malicious code or content you have no right to share.
  • Do not resell or provide the service to third parties except as permitted.

Compliance information disclaimer

Opsmera helps you track regulatory deadlines and maintain records, but it is a tool, not legal or compliance advice. Responsibility for meeting AS 1851, AFSS, AESMR and other obligations remains with you and your licensed practitioners. We do not guarantee any regulatory outcome.

Fees

Paid plans are billed per the pricing agreed at sign-up. Pilot and promotional terms, where offered, apply as described at the time. Fees are exclusive of taxes unless stated.

Warranties and liability

The service is provided on a reasonable-efforts basis. To the extent permitted by law, we exclude implied warranties and limit our liability for the service. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.

Termination

You may stop using the service at any time. We may suspend or terminate access for breach of these terms or non-payment. On termination, we will make your data available for export for a reasonable period before deletion, subject to legal retention requirements.

Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts of that jurisdiction.
